Job Description

Subrogation and Property Damage Attorney

United Automobile Insurance Company

• Represent insurers or clients in claims involving damage to real or personal property (e.g., vehicle damage, fire, water, hail, vandalism). • Investigate cause of damage, assess liability, and evaluate repair estimates or total loss value. • Review and analyze property appraisals, engineering reports, and repair invoices. • Negotiate settlements with opposing counsel, third parties, or claimants. • Pursue recovery from at-fault third parties after a claim has been paid by the insurer. • File lawsuits or arbitration claims against liable parties (e.g., other drivers, contractors). • Collaborate with adjusters to review subrogation potential and gather evidence. • Manage pre-litigation demand letters and post-litigation recovery efforts. • Represent the company in all phases of litigation, from pre-suit investigations to trial and post-trial activities. • Develop case strategies, draft pleadings, motions, discovery, and attend depositions, mediations, hearings, and trials. • Provide expert legal advice to the claims department, management, and other internal teams regarding property damage claims. • Ensure that all actions taken during the claims process comply with applicable laws and regulations. • Advise on legal risk related to policy interpretations, claims settlements, and potential exposure. • Negotiate settlements on behalf of the company in a timely and cost-effective manner. • Participate in mediations, arbitrations, and settlement conferences with a focus on favorable outcomes for the company. • Conduct thorough legal research on property damage, insurance laws, and regulations in Texas, including recent court decisions and statutory developments. • Prepare clear, concise, and persuasive legal documents such as briefs, memoranda, and opinions. • Stay current with changes in insurance and property damage laws in Texas, ensuring the company is compliant with local, state, and federal laws. • Assist in developing policies and procedures to minimize legal exposure and maximize operational efficiency. • Collaborate with the claims department, adjusters, and other legal teams to provide proactive and responsive legal support. • Communicate complex legal concepts and strategies to non-legal personnel clearly and effectively.

Job Requirements

  • Juris Doctor (JD) from an accredited law school.
  • Admission to the Texas Bar and good standing.
  • Bilingual in English and Spanish is highly desirable.
  • Strong understanding of insurance laws and regulations.
  • Ability to analyze complex legal issues and develop effective strategies.
  • Proficient in legal research tools and case management software.
  • Minimum of 3-5 years of years of experience in personal injury law, with a focus on automobile accidents.
  • Strong litigation experience with trial skills preferred.
  • Excellent negotiation, oral advocacy, and legal writing skills.
  • Ability to handle a high volume of cases and prioritize effectively.
  • Proficiency in case management software, legal research tools, and Microsoft Office.
