Role Description Stretto is hiring a Senior Associate in our Recovery Services group. In this exciting role, you will help manage a fast-paced and dynamic part of our business. The Senior Associate, Recovery Services plays a central role in the administration of client work, which focuses on data analysis and resolution of matters relating to Demand Letters or Complaints asserting preferential transfer causes of actions pursued under Sections 547 of the US Bankruptcy Code. The Senior Associate will manage a case load personally, while also ensuring group responsibilities are completed effectively. The Senior Associate will interact with clients and assist and support partner counsel in connection with settlement negotiations relating to each matter. This will include obtaining and managing data, analyzing data / defense analyses asserted by opposing parties and/or counsel, and preparing independent data analyses in response. - Group level responsibilities include: - Responding to communications including requests for extensions from adversaries and requests for information. - Case tracker maintenance and creation / implementation of template responses. - Periodic projects such as preparation and distribution of Demand Letters, filing and service of Summonses and Complaints, and preparing portfolio-level reports and analyses. Below is a list of specific tasks that the Senior Associate, Recovery Services is responsible for: - Demand Letter / Complaint prep: - Work with clients to obtain materials needed to prepare defense analysis, demand letters and complaints. - Manage research on corporate names / addresses, registered agents. - Manage prep of Demand Letters and Complaints (e.g., review of drafts and data merge). - Manage production and mailing/filing of Demand Letters and Summonses / Complaints. - Perform other tasks as needed to facilitate Demand Letter / Complaint prep. - Assigned Cases: - Support partner counsel in settlement negotiations. - Evaluate data-based preference defenses asserted. - Conduct and/or facilitate secondary analysis. - Coordinate with partner counsel to respond to defenses. - Facilitate settlement negotiations. - Track receipt of settlement funds. - Report to direct supervisor on developments in assigned cases. - Overall Portfolio: - Support partner counsel in managing case communications. - Facilitating completion of secondary defense analysis. - Managing prep and execution of settlement documents and, when applicable, coordinate with counsel on motions seeking approval of settlement agreements. - Case Tracker maintenance: - Work with junior staff to maintain all trackers. - Set weekly or bi-weekly meetings to discuss issues with junior staff. - Ensure updated trackers are circulated at least bi-weekly. - Other Assigned tasks: - Address all tasks assigned by their direct supervisor promptly. - Communicate status on task completion daily or at intervals set by their direct supervisor. - Assist as needed in other areas of the Legal Claims Administration group. Qualifications - Bachelor’s degree. JD, MBA or CPA a plus. - Minimum of 5 years of experience as a bankruptcy paralegal, bankruptcy attorney, consultant, or accountant with experience in bankruptcy matters. - Strong knowledge of bankruptcy law. - Experience in managing, prosecuting, or defending preference actions. - Familiarity with statutory defenses to a preference action. - Excellent written and verbal communication skills. - Good data management skills. Proficient in Excel. - Demonstrated ability to manage multiple projects and deadlines in a fast-paced environment.
