The Senior Litigation & Product Counsel will manage disputes, oversee litigation strategy, and partner closely with product and business teams to proactively mitigate regulatory risk. This role involves advising on complex healthcare regulations, including CMS rules, the Anti-Kickback Statute, and the False Claims Act, while supporting innovative SaaS product development. You will serve as a trusted legal advisor across multiple functions, balancing litigation management, regulatory compliance, and strategic product counsel. Success in this position requires strong analytical skills, creative problem-solving, and the ability to navigate ambiguity while delivering practical, actionable solutions. The role offers significant visibility, autonomy, and the chance to influence legal strategy across both operational and product initiatives. - Manage disputes with healthcare providers and vendors, including actual and threatened litigation, and initiate affirmative litigation where necessary to protect the company’s interests. - Provide day-to-day legal advice to business and product teams on Medicare Advantage operations and SaaS product offerings, including regulatory compliance with CMS, AKS, and FCA. - Partner with product teams to advise on feature development and mitigate regulatory or litigation risk. - Identify potential areas of legal exposure and develop strategies to minimize risk while supporting business objectives. - Serve as primary legal counsel for Payment Integrity and Special Investigations units, offering guidance on complex operational matters. - Draft, review, and negotiate contracts, policies, and legal documents relevant to business and product initiatives. - Maintain awareness of healthcare regulatory trends and emerging litigation matters to anticipate and advise on potential impacts. Qualifications - J.D. degree from an accredited law school and active bar membership. - Minimum of 4 years’ experience in litigation, investigations, or product counseling, ideally at a large law firm. - Experience advising health insurance clients, particularly in managed care, with familiarity in AKS, FCA, and CMS regulations. - Proven ability to develop strategies that mitigate litigation and regulatory risk. - Strong analytical, problem-solving, and strategic thinking skills. - Excellent verbal and written communication skills with the ability to present complex information clearly to executives and cross-functional teams. - Detail-oriented, collaborative, and able to thrive in a fast-paced, changing environment. - Ability to create and implement processes with cross-functional business partners. - High degree of professional judgment, ownership, and accountability.
