Underwriting Counsel
Ardán®
• Analyze title insurance risks, underwriting issues, and regulatory concerns • Provide underwriting solutions to agents, sales team, and title examiners in accordance with Westcor company guidelines as well as local, state and federal law • Handle residential as well as commercial transactions underwriting • Present training seminars to educate title agents and production staff (both online and in person) • Provide outstanding customer service while making sound underwriting decisions • Analyze and respond to indemnity requests • Call on existing Westcor agents and help increase wallet share. Identify new business opportunities through prospecting • Travel with sales staff, managers or other underwriters for agent visits throughout the states
Job Requirements
- J.D. degree
- Minimum 3 years of experience concentrated in North Carolina real property and title insurance
- Must be a member in good standing with the North Carolina Bar
- Strong knowledge of NC, SC, and Georgia real property law and the title insurance industry

The Team: Upstart’s Legal team partners closely with Capital Markets and Finance to support the funding strategies that power our lending platform. The team works across securitizations, whole loan sales, and other liquidity channels, helping structure transactions and manage legal risk as the business grows. As a Senior Legal Counsel, Capital Markets, you will support the execution of key financing transactions and provide practical legal guidance across investor-facing activities. You’ll work cross-functionally to help scale processes and ensure consistency across a growing set of products and funding structures. How you’ll make an impact - Support capital markets and finance teams on purchase and sale agreements, securitizations, and other liquidity arrangements, as well as day-to-day legal support - Draft, review, and negotiate transactional documents with institutional investors, including asset managers, private equity firms, hedge funds, and pension funds - Partner with internal stakeholders and external counsel to support structuring and execution of securitization transactions, including pass-through and asset-backed structures - Contribute to managing deal flow, timelines, and documentation across multiple concurrent transactions - Collaborate with legal, product, and regulatory teams to ensure consistency across agreements and alignment with evolving requirements - Maintain and improve transaction templates and processes to support efficient and scalable execution - Provide guidance on legal risks and contribute to internal education on capital markets topics Minimum Qualifications - Juris Doctor (J.D.) degree and active membership in at least one U.S. state bar - 5+ years of legal experience in structured finance, debt finance, capital markets, or a related practice area - Experience drafting and negotiating transactional agreements in financing or capital markets contexts - Experience working with cross-functional stakeholders and external counsel on complex transactions Preferred Qualifications - Experience working at a fintech or lending-focused company - Knowledge of asset-backed securitizations and capital markets structures - Ability to manage multiple transactions with competing priorities and timelines - Skills in developing or improving legal templates and transaction processes - Ability to communicate legal concepts clearly to business and non-legal stakeholders Position location This role is available in the following locations: Remote Time zone requirements The team operates on the East/West coast time zones.
