• Implement, and maintain an Outsourcing Policy that complies with MiCA Guidelines on outsourcing arrangements • Maintain a comprehensive and up-to-date Register of Outsourcing Arrangements, prepared for regular submission and audit by the Regulator • Conduct thorough pre-outsourcing risk assessments to determine if a function is "critical or important" and evaluate the potential impact on operational resilience • Lead the due diligence process for new vendors (IT, Cloud, KYC, Custody, etc.), assessing their financial stability, security standards, and ability to meet regulatory requirements • Collaborate with the Legal and Compliance Team to ensure all outsourcing contracts include mandatory regulatory clauses (e.g., audit rights, data protection/GDPR, exit strategies, and sub-outsourcing controls) • Establish Service Level Agreements (SLAs) and Key Performance Indicators (KPIs) to monitor vendor performance and ensure service quality remains consistent • Develop and periodically test robust exit strategies for critical outsourcing arrangements to ensure business continuity in the event of service failure or termination • Manage "Intra-group" outsourcing between BingX EU and other BingX global entities, ensuring all shared services are documented and managed on an arm's-length basis • Coordinate and facilitate "right to audit" inspections of third-party service providers, ensuring compliance with security and operational standards
